1. Submit a remonstration or file a lawsuit
Remonstration
You have the option of submitting a remonstration to the embassy. This must be done in writing within one month. If the notice of refusal does not contain instructions on how to appeal, the deadline is one year. In your remonstration, you should explain in detail why the grounds for refusal do not apply and, if necessary, submit additional documents that could help to clarify the situation. The aim is to dispel the authority's doubts about your willingness to return home. If a remonstration is lodged against the visa decision, the responsible consular section will issue a remonstration decision. An appeal against this decision must be lodged within one month.
Lawsuit
Another option is to bring an action before the Berlin Administrative Court. Here too, the action must be brought within one month. In this case, the Federal Republic of Germany is represented by the Federal Foreign Office as the defendant. Here too, the reasons for the unlawfulness of the rejection must be presented in order to convince the court that there is no risk of unlawful immigration.
2. Which approach is more effective?
Various factors determine which approach is more effective. Remonstration is cheaper and can be tried first without losing the right to bring an action. However, foreign representations rarely change their decisions on the basis of remonstrations. A lawsuit offers the opportunity for the court to re-examine the facts of the case and can prove advantageous, especially for people who travel frequently.
